A New York prosecutor in charge of the sex assault case against Harvey Weinstein has dropped part of the case, the Associated Press reported.

Weinstein was in court as his lawyers tried to get the criminal charges against him dismissed, ABC News reported.

The Manhattan district attorney dropped the charges connected to the allegations made by Lucia Evans, she is the woman who claimed that Weinstein forced her to perform a sex act in his office in 2004, ABC News reported. It was the allegations that came to light in The New Yorker article last year.

The judge presiding agreed with the move, USA Today reported.

He still faces trial on other charges stemming to allegations from 2013 and 2006 from different women, ABC News reported.

More than 75 women have accused Weinstein of sexual abuse. In June, he pleaded not guilty to six felony sex crimes, WCBS reported.

Weinstein’s attorney argued that the grand jury didn’t see all of the evidence in his defense. The evidence includes dozens of emails from one of the woman that attorney Benjamin Brafman says shows that the woman had a consensual relationship with Weinstein for years, WCBS reported.
